1. About These Terms
1.1 These Terms & Conditions govern the sale of products by Brizebox Ltd (“Brizebox”, “we”, “us” or “our”) to you (“the Customer”, “you” or “your”).
1.2 By placing an order with us, you agree to these Terms & Conditions.
1.3 We may update these Terms & Conditions from time to time. The terms applicable to your order will be those in force when your order is accepted by us.
1.4 Nothing in these Terms & Conditions is intended to exclude or restrict any rights you have under applicable UK consumer law.

2. Products
2.1 We make every reasonable effort to ensure that product descriptions, photographs, dimensions, specifications and other information displayed on our website are accurate.
2.2 Product colours may appear slightly different depending on screen settings, lighting and manufacturing tolerances.
2.3 Dimensions are provided as accurately as reasonably possible. Minor manufacturing tolerances may occur.
2.4 We may make minor changes to product specifications where necessary, provided those changes do not materially affect the function or quality of the product.
2.5 Before ordering, you are responsible for checking that the product dimensions and specification are suitable for your intended location and installation.
2.6 For Built-In/Flat Top Brizeboxes and frames in particular, customers should check all relevant opening, wall and installation dimensions before installation begins.

3. Orders
3.1 An order is placed when you submit an order through our website or otherwise confirm an order directly with us.
3.2 Receipt of an order does not necessarily mean that we have accepted it.
3.3 A contract between you and Brizebox Ltd is formed when we accept your order.
3.4 We reserve the right to refuse or cancel an order where, for example, a product is unavailable, there is an obvious pricing or description error, we are unable to obtain authorisation for payment, we are unable to deliver to the address supplied, or we reasonably suspect fraudulent or unauthorised activity.
3.5 If we cancel an order after payment has been received, we will refund the amount paid for the cancelled goods.

4. Prices and Payment
4.1 Prices displayed on the website include VAT where applicable unless stated otherwise.
4.2 Delivery charges will be shown separately where applicable.
4.3 We take reasonable care to ensure prices displayed on our website are correct. If an obvious pricing error occurs, we are not obliged to supply a product at an incorrect price.
4.4 Payment must be made using one of the payment methods offered at checkout or otherwise agreed with Brizebox Ltd.
4.5 For orders placed by quotation or invoice, any payment terms stated on the quotation or invoice will form part of the contract.

5. Pre-Orders and Out-of-Stock Products
5.1 From time to time, products may be offered for pre-order before stock arrives at our warehouse.
5.2 Any expected stock arrival or dispatch date provided for a pre-order is an estimate and may change due to circumstances outside our reasonable control, including manufacturing delays, shipping delays, customs clearance, port disruption or other transport issues.
5.3 We will make reasonable efforts to keep customers informed of material delays.
5.4 Your statutory cancellation rights are not affected by placing a pre-order.

6. Delivery
6.1 We aim to dispatch in-stock products as quickly as reasonably possible. Any dispatch or delivery date provided is an estimate unless we have expressly agreed a guaranteed date with you.
6.2 Delivery is normally carried out by a third-party courier or freight provider.
6.3 We are not responsible for delays caused by circumstances outside our reasonable control. This does not affect any statutory rights you may have where goods are not delivered within a legally required or specifically agreed timeframe.
6.4 You are responsible for providing a complete and accurate delivery address, telephone number and any relevant delivery instructions.
6.5 If a delivery cannot be completed because incorrect information has been provided, nobody is available to receive a delivery where attendance is required, or the customer otherwise fails to take delivery, we may charge reasonable additional delivery, storage or redelivery costs.
6.6 Large and Extra-Large products may require specialist courier or pallet delivery.
6.7 Please inspect the packaging and product as soon as reasonably possible following delivery and contact us promptly if there is evidence of transit damage. Photographs of the product and packaging may be requested so that we can investigate the damage with the carrier.

7. Risk and Ownership
7.1 For consumer orders, risk in the goods passes to you when the goods come into your physical possession or the physical possession of a person identified by you to receive them, subject to applicable consumer law.
7.2 Ownership of the goods will not pass to you until we have received payment in full.

8. Consumer Right to Cancel Online Orders
8.1 If you are purchasing as a consumer online, by telephone or through another distance-selling method, you normally have a legal right to change your mind and cancel your order.
8.2 You have 14 days from the day after you receive the goods to tell us that you wish to cancel.
8.3 Where an order contains multiple goods delivered on different days, the cancellation period will normally run from the day after you receive the last item.
8.4 You do not need to give us a reason for cancelling.
8.5 To exercise your right to cancel, please contact us clearly stating that you wish to cancel the contract at [email protected] or by post at the Brizebox Ltd address shown above.
8.6 After notifying us that you wish to cancel, you must return the goods without undue delay and normally within 14 days of notifying us of your cancellation.
8.7 These cancellation rights are subject to the exceptions provided by law, including, where applicable, goods made to a customer’s specification or clearly personalised goods.

9. Returns Following a Change of Mind
9.1 Unless the goods are faulty, damaged or incorrectly supplied, the customer is responsible for the direct cost of returning the goods.
9.2 Brizeboxes are large and heavy products. Return transport costs can therefore be significant. Please contact us before arranging a return if you would like assistance identifying an appropriate return method.
9.3 Extra-Large units and other products originally delivered by pallet or specialist freight may need to be returned using an appropriate pallet or freight service to prevent damage.
9.4 You are responsible for taking reasonable care of the goods while they are in your possession and for ensuring they are appropriately packaged for return.
9.5 You may inspect the product as you would reasonably be able to inspect it in a shop. However, if the product has been handled beyond what is reasonably necessary to establish its nature, characteristics and functioning, we may make an appropriate deduction from the refund to reflect any reduction in its value, where permitted by law.
9.6 In particular, installation, drilling, fixing, modification, damage or other handling beyond what is reasonably necessary to inspect the product may result in a reduction in the amount refunded if this has diminished the value of the goods.
9.7 Original packaging should be retained and used wherever reasonably possible as it is specifically designed to protect these large products during transportation. The absence of original packaging does not, by itself, remove statutory cancellation rights.
9.8 We may, entirely at our discretion, agree to accept an unwanted item outside the statutory cancellation period as a gesture of goodwill. Any such acceptance will be considered individually and does not create an ongoing right to return products outside the statutory period.

10. Refunds Following Cancellation
10.1 Where you validly exercise your statutory right to cancel, we will refund the price paid for the goods together with the cost of our least expensive standard delivery option, where required by law.
10.2 If you selected a more expensive delivery service, we are not required to refund the additional amount above our standard delivery charge.
10.3 We may withhold the refund until we have received the goods back or you provide evidence that you have returned them, whichever occurs first, where permitted by law.
10.4 Refunds will normally be made using the same payment method used for the original transaction unless otherwise agreed.
10.5 We will process refunds within the timescales required by applicable consumer law.

11. Faulty, Damaged or Incorrect Goods
11.1 Your rights where goods are faulty, damaged, not as described or not fit for purpose are separate from your right to change your mind.
11.2 Brizebox Ltd complies with the Consumer Rights Act 2015 and other applicable consumer legislation.
11.3 Goods supplied to consumers must be of satisfactory quality, fit for their intended purpose and as described.
11.4 If you believe a product is faulty, damaged or incorrectly supplied, please contact us as soon as reasonably possible at [email protected].
11.5 We may ask you to provide photographs, video or other reasonable information about the problem so that we can identify the issue and determine the appropriate remedy.
11.6 Depending upon the circumstances and your statutory rights, the appropriate remedy may include a refund, repair, replacement or price reduction.
11.7 Nothing in these Terms & Conditions limits your statutory rights in relation to faulty goods.

12. Brizebox Warranty
12.1 Brizebox products are supplied with a 3-year warranty, subject to the terms and exclusions applicable to that warranty.
12.2 The warranty is in addition to, and does not replace, your statutory consumer rights.
12.3 The warranty does not cover damage resulting from misuse, accidental damage, forced entry, vandalism, incorrect installation, unauthorised modification, neglect or normal wear and tear where such exclusion is permitted by law.
12.4 If you experience a problem with your Brizebox, please contact us and provide details of the issue, together with photographs or video where appropriate.

13. Installation
13.1 Customers are responsible for ensuring that a Brizebox is suitable for its intended installation location before installation begins.
13.2 Any installation instructions supplied with the product should be followed.
13.3 Where professional skills are reasonably required for an installation, we recommend using a suitably competent installer.
13.4 Brizebox Ltd will not be responsible for damage caused by incorrect installation, modification of the product, failure to follow installation instructions or installation into an unsuitable structure, except where liability cannot legally be excluded.
13.5 Customers should check the product and confirm that the correct model, size and colour have been supplied before permanent installation.
14. Business Customers
14.1 If you purchase goods wholly or mainly for purposes relating to your trade, business, craft or profession, you are purchasing as a business rather than as a consumer.
14.2 Consumer cancellation rights, including the 14-day distance-selling cancellation right described above, do not apply to business purchases unless we expressly agree otherwise.
14.3 Returns by business customers are therefore subject to prior agreement by Brizebox Ltd unless the goods are faulty, incorrectly supplied or other contractual rights apply.
14.4 Nothing in these Terms excludes liability that cannot lawfully be excluded.

15. International Orders
15.1 We may accept orders for delivery outside mainland Great Britain.
15.2 Delivery charges for international and offshore destinations may be quoted separately.
15.3 Additional charges may apply due to the size, weight or destination of an order.
15.4 Unless we expressly quote a delivery service on a DDP (Delivered Duty Paid) basis or otherwise expressly state that duties and taxes are included, the customer may be responsible for import VAT, customs duties, clearance charges and other taxes or fees imposed in the destination country.
15.5 Where we expressly agree a particular Incoterm for an international business shipment, the Incoterm stated on our quotation, order confirmation or invoice will apply.
15.6 International customers are responsible for checking any local installation, building or regulatory requirements applicable to the product.

16. Intellectual Property
16.1 All intellectual property rights in the Brizebox website and Brizebox materials, including text, photographs, graphics, designs, drawings, product information, branding and other content owned by Brizebox Ltd remain the property of Brizebox Ltd or the relevant rights holder.
16.2 Website content must not be reproduced, distributed or used for commercial purposes without prior written permission.

17. Liability
17.1 Nothing in these Terms & Conditions excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation.
17.2 Nothing in these Terms & Conditions affects your statutory rights as a consumer.
17.3 We will not be responsible for losses that we could not reasonably have foreseen when the contract was entered into.
17.4 If you are a consumer, we supply products for private use. We will not be responsible for business losses, including loss of profit, revenue, business opportunity or business interruption arising from a consumer purchase, to the extent permitted by law.
17.5 Separate limitations may apply to contracts with business customers, subject always to applicable law.

18. Events Outside Our Control
18.1 We will not be responsible for a delay or failure to perform our obligations where caused by an event outside our reasonable control.
18.2 Such events may include severe weather, strikes, port disruption, shipping delays, transport disruption, customs delays, acts of government, war, civil disturbance, fire, flood, epidemic or pandemic, failure of utilities or telecommunications, or significant disruption affecting our manufacturers, suppliers or carriers.
18.3 We will take reasonable steps to minimise the effect of such events and will contact affected customers where appropriate.
18.4 Your statutory rights remain unaffected.

19. Privacy and Data Protection
19.1 Brizebox Ltd processes personal information in accordance with applicable UK data protection law, including the UK GDPR and the Data Protection Act 2018.
19.2 Personal information supplied when placing an order may be used to process your order, take payment, arrange delivery, provide customer service, administer warranties and comply with our legal obligations.
19.3 We may provide necessary information to third parties involved in fulfilling your order, including payment processors, couriers and freight providers.
19.4 Further information about how we use personal data is contained in our Privacy Policy.

20.1 We want to resolve any problem with your order as quickly and fairly as possible.

21. General
21.1 If any provision of these Terms & Conditions is found to be unlawful or unenforceable, the remaining provisions will continue in force.
21.2 A delay by us in enforcing any provision of these Terms does not mean that we have waived our right to enforce it.
21.3 You may not transfer your rights or obligations under a contract with us without our prior written consent, except where applicable law provides otherwise.
21.4 We may transfer our rights and obligations under the contract where this does not reduce your rights under the contract.

22. Governing Law
22.1 These Terms & Conditions and contracts between Brizebox Ltd and customers are governed by the laws of England and Wales.
22.2 If you are a consumer, you retain any rights you have under applicable law concerning where legal proceedings may be brought.

PLEASE NOTE: Our guarantee has changed from 2 years to 3 years on 23rd January 2025 for new orders. Any boxes purchased before this date will remain covered by the 2 year guarantee as stated at the time of purchase.

We guarantee your Brizebox will be free from defects in materials and workmanship for a period of 3 years from the date of purchase.
